Welcome to Bivastra Inc. (“we,” “us,” or “our”), a custom garment manufacturer based in Tirupur, Tamil Nadu, India. These Terms and Conditions govern your use of www.bivastra.com (the “Website”), including our WooCommerce store and Zakeke Designer services. By accessing the Website or placing an order, you agree to these Terms. We may update them periodically, and continued use of the Website indicates your acceptance of the revised Terms.

1. Eligibility and Use

  • You must be 18 years or older to use this Website.
  • You agree to provide accurate information when creating an account, placing orders, or making payments.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree not to misuse the Website for unlawful activities, distribution of viruses, or unauthorized scraping/copying.
  • All content, designs, and images on the Website are our intellectual property. User-uploaded designs grant us the right to use them solely for production and delivery of garments.

2. Products and Orders

  • All garments are custom-made. Orders proceed only after design clarification, approval, and payment confirmation.
  • Production Timeline: 35 days are required for sourcing, manufacturing, and finishing, after which shipping time applies.
  • Designs submitted via Zakeke Designer or otherwise approved cannot be modified once production begins.
  • Orders are considered binding upon payment.
  • Cancellations are permitted only within 24 hours of placing the order, subject to applicable fees.
  • While we strive for accuracy in descriptions, colors, textures, and measurements may vary slightly due to display differences and material sourcing.

3. Pricing and Payment

  • All prices are listed in INR unless otherwise stated. Taxes, duties, and shipping charges may apply.
  • Customers are responsible for customs duties or import taxes on international orders.
  • Payments are processed securely through Razorpay and WooCommerce payment gateways.
  • Orders are confirmed only after full payment authorization. Failed transactions result in automatic order cancellation.

4. Shipping and Delivery

  • Production: 35 days after confirmation and payment.
  • Delivery Timelines (after production):
    • Domestic (India): 5–10 business days
    • International: 10–20 business days (subject to customs clearance)
  • We use reliable courier services and provide tracking details via email/SMS.
  • Risk transfers to the customer once the order is shipped.
  • We are not liable for delays caused by carriers, customs, or circumstances beyond our control.
  • Customers must report missing or damaged shipments within 7 days of delivery.

5. Returns and Refunds

  • Customized garments are non-returnable and non-refundable, except in cases of:
    • Manufacturing defects
    • Wrong product delivered
  • Refunds are processed only for cancellations within the 24-hour window or for approved defective/incorrect items.
  • Refunds will be credited to the original payment method within 7–10 working days.

6. Warranties and Liability

  • We provide a 30-day warranty against manufacturing defects.
  • Products and services are offered on an “as is” basis; we make no guarantee of fitness for specific purposes.
  • Our liability is limited to the order value. We are not liable for indirect, incidental, or consequential damages.

7. Privacy and Data Protection

  • Your data is protected in accordance with our Privacy Policy.
  • By using the Website, you consent to the collection and processing of information necessary to complete transactions.

8. Force Majeure

We are not responsible for delays or failures caused by events beyond our control, including natural disasters, strikes, logistics disruptions, or government regulations.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of courts in Tirupur, Tamil Nadu.
